What is mediation?
Many people ask, ‘what is mediation?’ Essentially, mediation is a negotiation facilitated by a neutral third party. When two parties are unwilling or unable to resolve a dispute, mediation can be a good option. Mediation is usually a voluntary process, although can sometimes be required by court orders or statutes. Mediation is a very practical solution to resolving both private and commercial disputes.

Is mediation the right option for you?
Generally, a short term, structured and task orientated process, mediation can help parties resolve an issue. A mediator helps to find common ground and manage expectations. During mediation, the mediator is there to interpret concerns and relay that information between the parties. This helps to define the problems at hand with the aim of finding some sort of agreement.

Hopefully a resolution is reached! Mediation agreements may be oral or written, with the content varying due to the type of mediation. If an agreement hasn’t been reached, you may decide to pursue your claim in other forums. The mediation process is typically considered more prompt and inexpensive.
